03/10/2010

Facebook never sleeps - with 400 million active users on the social networking site and with the number growing by every minute, FaceBook has threatened the search engine giants who have been there much before FaceBook was even thought about. Social networks existed and people were using them for building their network of friends or be there with the existing friends from the comfort of their homes and share with them every tit bits of the day.

FaceBook changed everything. From being the social networking site for friends and peers it has developed into a platform that has now become a hub for business activities as well. FaceBook with time has grown, so much so, that it has threatened the search engine leader’s lead.

Hitwise reports that Facebook contributes 3.52% of clicks to news sites far surpassing Google News.

Google News, as Hitwise reports, lags behind Facebook contributing 1.4% of clicks to news sites.

With Google Buzz now launched and ready to counter Facebook, question is, whether things will flow Google’s way? Isn’t it a bit late from Google to come out with its social tool? Google had come out with its social networking site ‘Orkut’ before but the site did not gain popularity in the US or in the United Kingdom. Google Buzz, is the effort by Google to counter the popularity of Facebook.

Google has the edge, as it is the significantly large user base. With Gmail integrated with Google Buzz, the search engine giant makes it easier for the Gmail users to play their marketing and social networking game more effectively. With fast Google indexing of the feed and posts published by the users to appear in the Google search results Google buzz is all set to make its mark.

Bottom line - whether it is Facebook or Google Buzz, people (individuals and the businessmen) are now used to socializing online and the online networking service that is effective and provides cheaper and easier means to achieve their goals will be most liked and most used medium.

North Carolina Divorce & Family Law Firm - Gailor, Wallis & Hunt

Raleigh, North Carolina — The esteemed North Carolina divorce and family law attorneys at Gailor, Wallis & Hunt, PLLC constantly work on behalf of their clients to keep them informed of their rights as they relate to the laws of the state.

In keeping with their commitment, the divorce law firm issued an alert as to recent changes in North Carolina alienation of affection and criminal conversation laws.

When adultery is committed in a marriage, the domino effect of emotional distress of the partner who was cheated on is ten fold. The feelings of rejection, anger, grief and humiliation as well as potential loss of financial support, depression, and other factors are considered a personal injury in North Carolina, whose public policy is against the interference of a third party in a marriage.

The state of North Carolina recognizes two causes of action that allow an injured spouse to sue for money damages based on allegations of harm to the marital relationship caused by a third party. These causes of action are for “alienation of affections” and “criminal conversation.”

In North Carolina, the statute of limitations for both alienation of affection and criminal conversation is three years. The statute begins to run at the time of the loss of affection, which is determined on a case-by-case basis.

Previously, acts between the spouse and third party that occurred after the date of separation but before absolute divorce may still in some circumstances be plausible for a claim.

However, effective October 1, 2009, a plaintiff must file a claim within three years from the earlier of (a) the date of the last act or (b) three years from the date of separation, even if the alienating behavior and/or sexual intercourse continued after the date of separation.

Also effective October 1, 2009, claims may be brought against natural persons only; business entities may not be sued for these torts.

A $7 million lawsuit settlement with the city of Los Angeles was reached after a motorcycle accident at the Los Angeles Triathlon left a man a paraplegic.

Los Angeles, CA—A $7 million settlement has been reached with the city of Los Angles, after a volunteer for the 2007 Los Angeles Triathlon was involved in a collision that left him a paraplegic for the rest of his life. The volunteer was struck by a car while on his motorcycle helping to officiate the bicycle portion of the race, as reported by the Los Angeles Times.

Steve Albala, who was 60-years-old when the collision occurred, subsequently filed the lawsuit following the serious collision. Albala, who was on a motorcycle during the bicycle portion of the triathlon, was struck after a traffic officer told another vehicle to continue through an intersection, which was in the direct path of the volunteer. The collision threw Albala 20 feet into the air on impact, leaving him with a vertebral fracture and hospitalized for over two years. During his extended stay in the hospital, he underwent multiple surgeries in hopes of correcting his injuries. A police report that was drafted at the time of the accident stated that Albala was speeding and was responsible for the collision. The city of Los Angeles also paid out $250,000 to another race official who were riding with Albala on his motorcycle during the accident, and $500,000 was paid to the driver of the car who hit Albala.

Press Release Distribution (WiredPRNews.com) — The Fifth Circuit ruled for an employer in a workplace retaliation matter. Johnson v. Diversicare Afton Oaks LLC, No. 08-20827 (5th Cir. Feb. 17, 2010), available at http://www.ca5.uscourts.gov/opinions/pub/08/08-20827-CV0.wpd.pdf.

The plaintiff, an assistant director at a nursing home, failed to investigate an alleged incident of resident abuse and was suspended pending an investigation into her failure to investigate the alleged incident of abuse. Following the investigation, she was asked to return to work but declined to do so because she had already filed a retaliation claim against her employer.

Texas law protects a nursing home employee from retaliation by an employer if the employee reports a violation of law. Here, the employer moved for summary judgment, alleging that the plaintiff failed to actually make a report. Evidence showed that, while the plaintiff telephoned a Texas agency on the relevant date, she did so merely to ask a question and did not report a violation of law. Further, while the plaintiff argued that an employer can be held liable for retaliation when an employee is punished for the intent of reporting, she failed to show any causal relationship between her intent to report a violation and the retaliatory action of suspension. Accordingly, the Court affirmed the district court’s grant of summary judgment.

Personal injury lawyer alerts- Study reveals food contamination and foodborne illness outbreaks have resulted in $152 billion in medical costs and other expenses.

Washington, DC (News)—A new study conducted by the Produce Safety Project at Georgetown University exposed the true expenses associated with foodborne illness outbreaks…$152 billion dollars a year. Prior estimates regarding such medical-related costs, formally issued by the U.S. government, stated that expenses ranged from $7 billion to $35 billion annually. The study was released on Wednesday, March 3, 2010, according to information provided by Reuters.

While previous estimates were based on limited medical costs and pathogens, the Produce Safety Project’s study took into account 27 notorious pathogens, which included salmonella and listeria, and a broader spectrum of health-related expenses, subsequently resulting in the updated cost estimate of $151 billion a year. Food contamination threats have prompted a seemingly incessant slew of product recalls and caused many consumers to become sickened and under certain circumstances, die from these foodborne illnesses. Potential food borne illness hazards and occurrences tend to result in profit losses for manufacturers forced to recall tainted products. For instance, Kellogg Co. was forced to recall contaminated peanut butter, resulting in approximately $70 million in losses.

Such consumer health safety risks and episodes are also allegedly responsible for “medical costs, lost productivity and quality of life”, according to the study. The U.S. Centers for Disease Control and Prevention (CDC) http://www.cdc.gov noted that 76 million people are sickened as a result of food poisoning each year, with 5,000 of these illnesses tragically proving fatal. Congress is reportedly expected to work towards improving food safety legislation this year, for the first time in 50 years.

Legal news for product liability attorneys. The family of a woman who was killed by a salmonella infection filed a lawsuit against U.F. Union International Food.

Union City, CA—A lawsuit has been filed against U.F. Union International Food on behalf of a deceased woman who died from a salmonella infection last year, which was acquired from consuming tainted pepper that was sold by the defendant. The lawsuit was filed on Thursday, February 25, 2010 in the Alameda County Superior Court in Oakland, as reported by the San Jose Mercury News.

Donna Pierce, 69, of San Leandro contracted the salmonella infection from pepper sold, manufactured, and distributed by U.F. Union International Food. Pierce was recovering from lung surgery while at Kaiser Hospital in Hayward, when she consumed the tainted pepper. Pierce died in April after loosing her battle against the bacterial infection.

According to the lawsuit, Pierce’s death was caused by last year’s salmonella outbreak, which caused infections in at least 33 Californians and 87 West Coast residents. The lawsuit also listed Foodservice Partners of California LLC and Delaware-based companies Foodservice Partners Inc., and Sysco Corporation. The plaintiff, Tamara Lucier, 50, of Huntington Beach, who is Leandro’s daughter, is seeking unspecified damages on behalf of her family, which includes reimbursement of medial and funeral expenses. U.F. Union International Food sold the tainted white pepper under several brand names.

Montreal alcohol rehab center says New York criminal attorneys can help their clients stay out of prison, recover, and save U.S. tax dollars.

New York, NY (press release)–Chatsworth a short-stay alcohol rehab center in Montreal claims with one year jail terms at $45,000 annually DUI lawyers can help their clients recover. When a DUI attorney advises their repeat offender client to enter a three week alcohol recovery program to receive the recovery help they need for their alcohol problem the criminal lawyer offers good will for all involved including great savings to U.S. tax payers. DUI attorneys and nonviolent criminal lawyers can offer the solution to their client’s binge drinking and alcohol abuse that causes them to continue to get behind the wheel of a motor vehicle and drive while impaired.

Many professionals commit illegal acts like driving under the influence (DUI) because they are suffering from a disease. Alcohol abuse and addictive behaviors like binge drinking are medical diseases and are legitimately diagnosed by mental health professionals and doctors. Unfortunately, many people who suffer from alcohol abuse go untreated and unnoticed until they break the law and land in front of a judge in the United States court system. These criminals need to be treated for their alcohol issues and because they repeatedly do not receive the recovery help they need, they continue to repeatedly drink and drive. Many repeat DUI arrests across the U.S. are because the accused criminal is suffering from alcohol addiction. Prisons and jails offer incarceration, not alcohol rehabilitation.

When people are in the throes of active alcohol abuse they participate in socially and legally unacceptable behaviors because they are mood and mind altered. The consequences of these illegal self-defeating behaviors, like driving while intoxicated (DWI) lead to arrests by law enforcement officers. Criminal attorneys across the U.S., representing DUI and nonviolent alcohol offenders are fighting to maintain their clients’ freedom but find themselves baffled by the dilemma of their client being sentenced to lengthy jail and prison terms when what they need is medical care and recovery so they will stop drinking and driving once and for all. The professionals at Chatsworth alcohol rehab in Montreal assert judges in the U.S. court system look more favorably upon the suffering DUI offender who is actively seeking help for the root cause of their illegal activity, which is the disease of addiction. Lengthy jail and prison sentences place these individuals in an already over crowded penal system at a high taxpayer cost ($45,000 per year per inmate) where they don’t receive treatment for their alcohol abuse problem.

Chatsworth in Montreal offers a solution for your clients’ repetitive and baffling self-defeating habits. Through alcohol rehab and addiction recovery by licensed mental health and addiction professionals, repeat DUI offenders can successfully return to society and stop their drinking and driving which puts innocent people at risk and costs thousands. These otherwise normal individuals go back to being the healthy people they once were as productive members of their communities and cease their repetitive self-defeating behaviors that led to their criminal activity. If your clients need help with their medical issues of alcohol abuse while you are fighting to maintain their legal rights contact Chatsworth Pavilion in Montreal for a private consultation.

Arizona automobile accident lawyers alert- A drowsy driver caused a crash that injured three people in North Phoenix.

Phoenix, AZ—A chain-reaction crash involving five vehicles was sparked by a driver who fell asleep behind the wheel on Wednesday morning, March 3, 2010. The multiple vehicle collision occurred around 8:00 a.m., at 36th Street and Union Hills Drive in North Phoenix, as reported by AZFamily.com.

Police officials reported that the driver of pickup truck that was pulling a trailer apparently fell asleep while driving, which caused him to clip another truck. The truck then spun out-of-control and collided head-on into two other motorists. Rescue teams rushed to the scene of the motor vehicle collision (MVC) and extracted one person from one of the wrecked vehicles. Three people, including a 32-year-old man who sustained serious injuries, were reportedly rushed by responding emergency medical services (EMS) crews to a local hospital for treatment of their injuries. The seriously injured man was taken to John C. Lincoln Hospital. The condition of the other injured motorists was not reported. Union Hills Drive was shut down for at least an hour while crews cleaned up metal and debris that was scattered all over the roadway. Police officials are reportedly conducting a full investigation into the collision. At this time no one has been cited for the wreck.
