Dallas, TX (AmericanInjuryNews.com)–Texas Highway Patrol responded to a catastrophic car crash yesterday involving a minivan carrying 7 adults and children on Texas Highway 31. The driver of the van, Kristina Garcia, 31 of Overton, pulled in front of a semi-truck while merging onto the eastbound lane of Texas 31 at Old Texas 135. The big rig was carrying a large tractor trailer when she supposedly cut off driver of the semi-truck. The Department of Public Safety says the impact ejected her 6 year-old son. Emergency Medical Services personnel airlifted the ejected boy to LSU-Shreveport Medical Center. The other injured passengers included Adrienne Matlock, 25, of Kilgore and four children ages 2-months, 18-months, 2 years and 12 years old. They were all transported to East Texas Medical Center for their injuries and several were transferred to Children’s Medical Center in Dallas.

Thousands of Texas passengers are injured on the state’s roadways and highways every year. These passengers suffer soft tissue and catastrophic injuries including death. Passengers of motor vehicle collisions where the driver may be at fault, like the accident outlined above, do not understand they still have a claim for their injuries and damages. Passengers in cars of at fault drivers are led to believe they don’t have a claim because the driver was at fault. This is not true. Texas passengers need to understand when they are injured in a car crash or any other motor vehicle collision, they have a claim with the driver’s insurance company. Passengers need to understand the driver of the car pays for insurance coverage exactly for this reason.

As drivers of cars, our policies typically cover passengers who might be injured if we wreck the car. Insurance companies of at fault drivers will not contact the injured passengers and ask if they want to file a claim. They are hoping Texas passengers won’t file claims. If you don’t file the claim, they have no obligation to pay the benefits, of the policy, the driver has legitimately bought. It is estimated thousands of passengers injured in car crashes receive no compensation for their damages and injuries because they simply do not know they have a claim.A skilled personal injury attorney who specializes in all types of motor vehicle collisions can help with insurance company claims and litigation.
