Dallas, Texas (AmericanInjuryNews.com – News Report) – A charter bus’ trip from Houston, Texas to Carthage, Missouri, was abruptly interrupted when it slid 180 feet into the guardrail, and then flipped over the edge of a 12-foot embankment where it landed on its side. Ejected bodies covered in glass and dirt, along with luggage, and other personal belongings littered the scene around the crushed bus. 12 of the 54 passengers were killed instantly in the wreck and at least 4 or 5 more are barely holding on. Soon came the rush of police officers, ambulances and investigators.
The National Transportation Safety Board stated that the bus had a recapped Goodyear tire on its right front axle, which is a direct violation of federal safety rules. Federal rules permit recapped tires on this kind of passenger, charter busses, but only on axles not involved in the steering of the vehicle. A recapped tire is a tire that has had its original rubber tread replaced. Even though the other nine tires had their original treads, it only took one to cause this much damage. To compound the violation, the charter bus was owned by Angel Tours of Houston, currently operating illegally in the state of Texas. According to the Federal Motor Carrier Safety Administration, a branch of the U.S. Department of Transportation the company was rated unsatisfactory and unfit for interstate travel on June 23. An “unsatisfactory” rating is issued if “records indicate evidence of substantial noncompliance with safety requirements,” according to the agency. The company received the rating after a compliance review on May 1, according to the agency’s Web site.
Ironically, this accident happened less than one mile from the place where a trucker had crossed the median and killed ten people. Accidents such as these are not uncommon on our roadways across the United States. Our safety officials must ensure that trucks, buses and all types of motor vehicles are safe to operate. If they are overlooked, as in this case, the cost to life and property can be significant. Safety should be the highest priority in this country, especially on our roads. After this crash many are asking ‘now what?’ They are uncertain of who to turn to for advice, for recompense, for justice. Do not get stuck asking what to do next, when the lawyers at Eberstein and Witerite know just how to help you or a loved one.
